(Lincoln, NE) -- The Nebraska State Supreme Court is orrdering a candidate to be put back on the primary ballot after she was removed. Cynthia Burbank will be back on the ballot, but not until a back-and-forth court fight.

The Nebraska Republican Party had filed a complaint against Cindy Burbank, accusing her of being a plant. They said she has no intention of actually taking office. A district court agreed and ordered Burbank removed.

Burbank sued to be put back on the ballot.

The Nebraska State Supreme Court says the Republican complaint was too late, it wsa filed after the deadline, and Burbank's candidacy for the US Senate as a Democrat was filed on time and met all requirements. So they're overturning the lower court ruling and ordering the Secretary of State to put Burbank's name on the May 12 primary ballot as a Democratic candidate for the U.S. Senate.
