(Washington, DC) -- The U.S. Justice Department files a motion to dismiss a criminal case against a former Nebraska Congressman.
The DOJ motion dismisses the case against Jeff Fortenberry "with prejudice," which means it cannot be brought back again.
The former Republican First District Representative from Lincoln has twice been indicted over accusations of lying to the FBI.
His conviction the first time was overturned because the trial was held in Los Angeles instead of Nebraska or Washington D.C.
After his conviction, Fortenberry resigned from Congress.
