Psychiatric patient mistakenly discharged from prison taken into custody

A man who was mistakenly released from the Omaha Correctional Center on Monday is back in custody.

On Tuesday, the Nebraska Department of Correctional Services said that 28 year old Amjad Almusa had been arrested by the Nebraska State Patrol. NDCS says Almusa was discharged Monday morning, despite a court order to be committed to a state psychiatric hospital.

Prison officials say the order required that Almusa be transferred to the Norfolk Regional Center upon completion of his sentence at OCC. “Standard procedure is that an individual is held at the facility until the appropriate law enforcement agency assumes custody to fulfill the detainer or hold,” said Scott R. Frakes, director of the Nebraska Department of Correctional Services. “In this case, the hold was overlooked and the individual was released from the facility. The circumstances surrounding this release are under investigation.”

Almusa had received a one year sentence for two counts of assault on a Department of Health and Human Services employee out of Madison County. The circumstances surrounding his release remain under investigation by NDCS.
