City Prosecutor Responds To Demands In The James Scurlock Case

In a statement, Omaha City Prosecutor Matt Kuhse says it’s important to respect the grand jury process and not damage the integrity of the case as a group demands misdemeanor charges be filed against Jake Gardner in the shooting death of James Scurlock.

The night of May 30th, amid violent protests in response to the death of George Floyd, surveillance video showed the shooting outside Gardner’s bar "The Hive" that left Scurlock dead.

About 150 people sign a letter demanding Kuhse take action.

They believe if Gardner was a man of color this would be a different case.

“Because he’s Caucasian he’s not in jail; he doesn’t even have any misdemeanor charges, and at best that’s what he should have,” Jobina Lloyd told 6 News.

“All we’re asking for is for the city prosecutor to do his job. We’re not asking for anything outlandish, anything unreal, unreasonable. Just do your job,” Robert Wagner said.
