Homicide Suspect's Ex-Wife Speaks Out

The ex-wife of man accused of murdering a known child sex offender says he called her to tell her what he had done.

Kelly Tamayo, James Fairbank's ex-wife, tells 6 News that while she doesn't understand what happened, he told her it was what had to be done.

On Saturday, Omaha Police officers were called to a residence near 43rd and Pinkney Street for a shooting. Upon arrival, officers said they found the body of 64 year old Mattieo Condoluci inside. Fairbanks, 43, is behind bars for the killing, charged with criminal homicide.

Investigators tracked down Fairbanks Monday night near David City -- more than an hour west of the metro.

The murder victim, Mattieo, spent 2.5 years in jail for sexually assaulting a child in Sarpy County in 2006. He was previously convicted of attempted lewd or lascivious acts in Florida in 1994.

"I understand how that all built up for him and he just snapped," said Tamayo.

Investigators tell 6 News they believe Fairbanks is the same person who wrote a confession email to media organizations Monday.

In the letter, believed by investigators to be written by Fairbanks, he said he "felt sick to his stomach" with how the sex offender watched neighborhood children. And that the "messed up judicial system" will punish him more than the other guy got for sexually assaulting a child.

In the email, Fairbanks reportedly wrote that he has 'his own experiences with these types of predators' and that he couldn't 'in good conscious allow' Condoluci to victimize anyone else.

Fairbanks said he was looking for an apartment in the neighborhood -- and spotted the guy 'pretending to wash his truck', but was really 'staring at a group of kids playing in the street.' "I know this isn't the right thing and we can't condone killing by any means -- but somebody has to take into consideration all the factors here. We can't protect our kids in any other way from these people. We're just supposed to accept it when they move into our neighborhood," said Tamayo.

Fairbanks had been working at the Omaha Public Schools middle school alternative program since December. He was previously a paraprofessional at Morton Middle School.
