LINCOLN, Nebraska - A three judge panel has been assigned to hear the death penalty case of convicted killer Aubrey Trail.
6 News reports the Nebraska Judicial Branch announced the presiding judge on the panel will be Judge Vicky Johnson. She is the same judge that heard Trail's murder trial.
Judges Julie Smith and Michael Smith were randomly selected to serve on the panel. They will decide whether Trail receives the death penalty or life in prison.
Trail killed Sydney Loofe of Lincoln in 2017. He was found guilty last July. A motion has already been filed on his behalf declaring the death penalty as unconstitutional.
