One week after he was convicted of murdering Sydney Loofe, Aubrey Trail is seeking a new trial.
Loofe disappeared in 2017 after going on a Tinder date with Trail's girlfriend Bailey Boswell. Prosecutors say she and Trail carried out a plot to kill Loofe. Trail's attorneys said the judge in the case should have declared a mistrial after Trail slashed his own throat in front of the jury.
They cited other irregularities during the trial, including misconduct by the jury, but no specific examples were provided.
After two days of jury selection and 14 days of testimony, it took the jury less than three hours to convict Trail. Last Thursday, he waived his right to an aggravated circumstances hearing. Whether he gets the death penalty will be up to a three judge panel, but no date has been scheduled for that hearing.
Boswell is scheduled for a murder trial in October.
