Fate Of Man Accused In Fatal Shooting To Be Decided By Grand Jury

A grand jury will decide if charges will be filed against a man following a fatal Council Bluffs shooting.

Council Bluffs Police say just before 5:00 Sunday evening, officers were called to the area of Grace and Clinton streets for reports of a shooting that had just taken place. When officers arrived, they located 59 year old Russ Atkins, of Council Bluffs resident, lying dead in the street.

During their initial investigation, authorities discovered that Atkins had been involved in a domestic violence disturbance, with a woman, when 67 year old Stephen Hahn, of Omaha, attempted to intervene. Hahn pulled out a handgun during the altercation and fired one shot, which fatally wounded Atkins. 

Detectives determined that Hahn personally knew both Atkins and the woman, and that a protection order existed between Atkins and the woman. Hahn remained on the scene, was cooperative with detectives during the investigation and was legally permitted to be in possession of the handgun.

After consulting with Pottawattamie County Matt Wilber Monday morning, it was decided that the facts of this incident will be presented to a Grand Jury to determine whether Hahn will face any criminal charges. 

In order not to taint the Grand Jury members, no further information will be released by the Council Bluffs Police Department regarding this case.
