A tow truck driver has been found not guilty for a tow truck crash last January that killed two people. 57 year old James Helbert was facing Motor Vehicle Homicide charges for the crash on Highway 75
A car driven by 19 year old Khalil Jones had stalled on the Chandler Road exit lane on January 5 at 3:00 a.m. A Good Samaritan, 47 year old Shamus Dean came to his aid and pulled his pickup onto the shoulder.
Investigators say Helbert came along in the tow truck and crashed into the stopped car. Jones and Dean were standing outside of it and were killed. Two people in Jones' car were injured.
Prosecutors said Helbert had time and space to move over. But his attorney said both vehicles were not on the shoulder or any lights or cones to warn him.
The not guilty verdicts were returned by a Sarpy County jury on Thursday afternoon.
