New Charges Filed Against Cement Truck Driver In Deadly Crash

A man who was driving a cement truck when it overturned on a car, killing two men, is facing a new set of charges. 

On Tuesday, the Sarpy County Attorney's Office re-filed charges against Austin Holloway. Holloway was behind the wheel of the concrete truck at 120th and Giles Road last October when it tipped over crushing a car, killing two people.

The Deputy County Attorney tells 6 News that Holloway will face two charges of misdemeanor Motor Vehicle Homicide for the deaths of Michael Dearden and Phil Hertel. Holloway originally faced felony charges, but Sarpy County Judge Todd Hutton dismissed them in March.

Hutton said that the truck was carrying a full load and overweight at the time of the crash. He said he dismissed the felony charges because there was no evidence of reckless driving and evidence of how fast the truck was traveling at the time of the crash was inconsistent.

Holloway is expected to appear in court on Wednesday.
