Felony charges have been dismissed against 20 year old Austin Holloway, who's accused of causing a deadly accident last fall in LaVista.
Holloway was the driver of a cement truck that overturned at 120th and Giles Road last October and crushed a car at the intersection. Michael Dearden and Phil Hertel were in that car and both were killed.
Holloway had been charged with Reckless Driving Resulting in Felony Motor Vehicle Homicide. His attorneys had asked for a reduction to Careless Driving - Motor Vehicle Homicide.
A judge dismissed the felony charges on Thursday. Now it's up to prosecutors to decide if they will re-file charges and if so, what those charges will be.
