A Bellevue teen accused of making threats against Bellevue West High School was in court again on Tuesday to face an additional charge of Possession of Destructive Device.
Prosecutors say eighteen year old Nicholas Scott allegedly told fellow students that he was going to shoot anyone who left the building during a planned walk-out. After making the threat, Scott was removed from the school by a parent. Scott was later contacted by law enforcement and agreed to meet with investigators on February 22nd. During the meeting with officers, Scott was booked into Sarpy County Jail on a felony charge of Making Terroristic Threats.
A court affidavit revealed that investigators found Scott had "various unassembled materials that are commonly known to be used in the manufacturing of explosive devices" in his possessions. Those items included:
- A metal pipe with open end caps
- Plastic pipe tape so it could be closed
- Toy rocket propulsion engines
- Fireworks
- Homemade fuse from a firework
- Small nails
- Two packages of BB’s
Scott's attorney David Reed tells 6 News that his client has ever right to have those items in his possession. "There's nothing illegal about BB’s. There's noting illegal about fireworks. There's nothing illegal about nails. Just because of the surrounding circumstance, we understand the severity. If the things that they found are things that we're going to start throwing our kids in jail for - or even anybody - everybody better clean out their garage."
Reed says his client is innocent and has yet to stand trial, but Reed says his high school has already convicted him, adding that his client has no future at Bellevue West. "My client is going to withdraw from Bellevue West. He's getting ready to enroll himself in a university. He's going to complete his education and he’s going to go on to get into metal working like he wants. He's going to have a future."
Bond was set at $100,000 for the Terroristic Threats charge with an additional $25,000 tacked on for the Possession of a Destructive Device charge.
