Two Officers Fired After In-Custody Death

Two Omaha Police officers involved in the June in-custody death of Zachary Bearheels have been fired. 

Police Chief Todd Schmaderer called for the firing of officers Scotty Payne and Ryan McClarty days after the June 5th incident. 

Both officers went through the Loudermill Process, the process by which government employees go through before severe discipline. Payne and McClarty would have gone through hearings during this process where they would be given a chance to present their side of the story.  

After being given a chance to tell their sides, it was decided to agree with the chief's recommendation and as of Friday July 21st both McClarty and Payne will no longer be employed by the City of Omaha.  

According to the police report, during the incident Payne used his taser on Bearheels twelve times while McClarty mounted the man and punched him in the head multiple times. Omaha Police protocol states that after using the taser three times alternative methods should be used. 

As of Thursday, Douglas County Attorney Don Kleine said he is still deciding on whether he will file criminal charges against the officers.
