The family of a slain Omaha woman were given the okay to pursue their lawsuit against an Omaha mental health facility.
Nineteen year old Melissa Rodriguez was strangled and dumped in an open cemetery grave by her boyfriend Mikael Loyd in August of 2013.
On Friday, the Nebraska Supreme Court ruled that the lawsuit Rodriguez's family filed against the Lasting Hope Recovery Center should have never been dismissed.
Police had requested Loyd be held at Lasting Hope just prior to Rodriguez's death. The family's lawsuit puts the blame on the facility for not notifying the police when Loyd left the facility and killed Rodriguez.
After initially being found not mentally competent to stand trial, Loyd was eventually sentenced to 30-35 years in prison.
