Man Accused Of Murder Denied Bond

A man accused in a deadly South Omaha shooting made his first court appearance Tuesday.

At his hearing, a judge ordered that 21 year old Benjamin Guevara be held without bond.

Guevara is accused of shooting 21 year old Oziel Vazquez-Serrano in the face on Saturday near 36th and H Street and leaving Vazquez-Serrano in the middle of the street. He was transported to a local hospital where he was pronounced dead.

Prosecutors say witnesses saw a man pull a body out of a vehicle, before leaving it in the street. Witnesses were able to write down the license plate number and give it to police, which led them to Guevara.

In court, prosecutors say when officers went to Guevara's home Sunday morning to arrest him, he said, "I'm the one you're looking for." Guevara then led the officers to a gun that was hidden in a tree, and an ammunition clip on his front porch.

The gun is a .40 caliber that prosecutors say match the shell casings found at the scene of the shooting. Investigators say there was also quite a it of blood on Guevara's pants and in his car.

It is unclear whether Guevara is a legal resident or citizen of the United States. ICE reported that Guevara applied for a visa in 2012, and prosecutors argued that because of Guevara's uncertain immigration status he is a flight risk. Guevara's defense argued that he's been in the U.S. for ten years.

Guevara faces charges of First Degree Murder and Use of a Weapon to Commit a Felony.
