Doctors at the Lincoln Regional Center say convicted killer Anthony Garcia is competent to be sentenced in the death penalty case.
The three-judge panel will meet Thursday morning to decide if Garcia will receive the death penalty.
Judge Gary Randall sent Garcia for an evaluation two weeks ago after he refused to respond to any questions in court.
Randall saying in court, “Dr. Garcia if you do not respond to me, you leave me with no choice but to follow the third thing we discussed at the hearing last week was to have you sent to the Lincoln regional center to determine whether or not you’re competent."
Court documents show that Garcia's evaluation found, "that the defendant is competent to participate in the mitigating circumstances phase of this proceeding and sentencing."
Garcia has not only refused to speak to the judge, his defense team says that he was refusing to communicate with them as well.
He was found guilty in October 2016 of killing four people with ties to Creighton University Medical School.
