Two Men Facing Charges After Confrontation

Two men are facing charges after a burglary attempt in Council Bluffs Thursday night. 

Council Bluffs Police say officers were dispatched just before 10:00 to a home after a resident said a man was stealing items from his property. 

They say the resident, 59 year old Gauino Gutierrez, saw 34 year old Adam Daewood on his property, so Gutierrez armed himself with a small caliber rifle and confronted Daewood. 

Police say Gutierrez fired two shots in an attempt to scare the trespasser, but did not hit him. 

Daewood did suffer a leg injury due to bullet or concrete fragments hitting him. 

He was treated at a local hospital then taken to the Pottawattamie County jail where he was booked on Theft and Criminal Trespass charges. 

Gutierrez was cited for Discharging a Firearm in City Limits, which is a misdemeanor.
