Man accused of pointing shotgun at process server as they served papers

(Omaha, NE) -- An Omaha man is behind bars, accused of pointing a shotgun at a process server as they attempted to serve him civil papers.

The Douglas County Sheriff's Office says around 9:00 Thursday morning, a Process Server with their office attempted to serve civil papers to a man at a house near 25th Ave. and Mary Street. Investigators say the Process Server announced that he was with the Douglas County Sheriff’s Office made contact with the man, 57 year old Carlos Rodriguez, at the front door. DCSO says Rodriguez then turned, walked away for a brief moment and then returned to the door with a shotgun. Investigators say Rodriguez then racked a round into the chamber, pointed it at the Process Server and told him to get off his property.

DCSO say the Process Server, fearing for his safety, left the property and called 911. Officers from the Omaha Police Department and members of the Sheriff’s Office Fugitive Warrant Division responded to the scene, where they set up a perimeter around the house. Investigators say as law enforcement was preparing to make contact with Rodriguez, he came out of the house with his hands in the air.

Members from the Omaha Police Department and the Douglas County Sheriff’s Office took Rodriguez into custody without incident. The sheriff's office says during a search of the home, a pump style pellet gun and a shotgun were found.

Rodriguez was booked on a charge of Terroristic Threats and two counts of Possession of a Weapon by a Prohibited Person. All three charges are felony crimes.
