Businesses that sell CBD products in Council Bluffs were given notice to stop. Letters were distributed to those businesses last week after the City Council received complaints that several stores and even gas stations were selling products containing Cannabidiol. Only the five licenses dispensaries in Iowa are allowed to sell CBD products that are less than .3% THC.
The Narcotics Enforcement Task Force tells 6 News they will be doing compliance checks and hope they do not have to take action against those businesses.
In order to obtain CBD now, patients must have a prescription card designated by a physician and the patient must meet one of 11 conditions. All products obtained must be purchased at licensed facilities.
Ross Plum owns Greenstar Glass and received one of the letters. He tells 6 News, "We do understand that the product we carry is a federally legal product.It meets all federal regulations of being grown from the hemp plant and being under .3% THC." With that, Plum says he will comply and pull the products.However, they are also speaking to lawmakers so this issue can be rectified quickly.
The letter that was delivered to these businesses did state that rule changes are likely in the future from both federal and state agencies but for now the unlicensed sale of CBD is currently illegal.
