Man Found Not Guilty In Deadly Cement Truck Crash

A 21-year-old man who was behind the wheel of a concrete truck that killed two men in a crash last year in La Vista has been found not guilty on misdemeanor charges. 

Holloway was driving the concrete truck on Oct. 25 of last year at 120th and Giles. He tried to make a right turn when the truck suddenly tipped over and crushed a nearby vehicle, killing Michael Dearden and Phil Hertel. 

"I think anyone that loses a child the way that these folks have lost their children, it would be just a devastating situation,  says Ben Perlman with the Sarpy County Attorney's Office. 

On Friday, a six-member jury found Holloway not guilty on two misdemeanor charges of motor vehicle homicide.   Sarpy County Judge Todd Hutton dismissed felony charges in the case in April. 

After reviewing evidence, Hutton said he did not find enough evidence of reckless driving.  Holloway faced up to a year in jail for each misdemeanor charge.
